Terms of Service

These terms govern your access to and use of Pilot Computer. Please read them carefully — by using the service, you agree to them.

1. Acceptance of Terms

These Terms of Service (the “Terms”) form a binding agreement between you and Pilot Computer (“Pilot Computer,” “we,” “us,” or “our”) and govern your access to and use of our websites, applications, and related services (collectively, the “Service”). By creating an account, starting a subscription, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Pilot Computer is an educational study aid that helps student pilots prepare for the oral portion of an FAA practical test (checkride). The Service provides AI-powered mock oral exams led by “Maverick,” an AI persona that role-plays a Designated Pilot Examiner (DPE), along with adaptive follow-up questions, scoring, and feedback aligned to current FAA Airman Certification Standards (ACS).

At present, the Service supports preparation for the Private Pilot License (PPL). Pilot Computer is being built as a broader training platform, and we expect to add additional certificates, ratings, and stages over time. We may add, change, or remove features at any time as the Service evolves.

Maverick is an AI. It is not a human instructor or examiner, can make mistakes, and may produce responses that are inaccurate or incomplete. Always verify important information against authoritative FAA sources and your certificated flight instructor (see Section 9).

3. Eligibility & Accounts

You must be at least 16 years old to create an account and use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms.

When you register, you agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for:

  • Maintaining the confidentiality of your login credentials and any activity that occurs under your account.
  • Notifying us promptly at support@pilotcomputer.com if you suspect unauthorized use of your account.
  • Using a single account for your own personal use — accounts are individual and may not be shared (see Section 6).

We may suspend or terminate accounts that contain false information or that are used in violation of these Terms.

4. Subscriptions & Billing

Pilot Computer is a recurring membership. We currently offer two plans:

  • Monthly — $29 per month, billed every month.
  • Annual — $190 per year, billed once every twelve months.

Prices are in U.S. dollars and exclude any applicable taxes, which may be added at checkout. By starting a subscription, you authorize us and our payment processor to charge your payment method on a recurring basis.

Auto-renewal. Your subscription renews automatically at the end of each billing cycle (monthly or annually) at the then-current rate for your plan, unless you cancel before the renewal date. We will charge your payment method on file for each renewal.

Cancellation. You may cancel at any time from your account settings or by emailing support@pilotcomputer.com. Cancellation stops future renewals; you keep access until the end of the billing period you already paid for. Except as required by law or as described in Section 5, payments are non-refundable and we do not provide partial-period refunds or credits for unused time.

Price changes. We may change subscription prices. If we do, the new price applies to your next renewal, and we will give you reasonable advance notice and a chance to cancel before it takes effect.

5. Pass Guarantee & Refunds

We stand behind the Service with our “pass your oral or your money back” guarantee. If you do not pass the oral portion of your PPL checkride after genuinely preparing with Pilot Computer, you may request a refund of the membership fees you paid during your preparation, subject to the conditions below.

To be eligible for a guarantee refund, you must:

  • Have an active paid membership at the time of your checkride.
  • Have completed at least eight (8) full mock oral sessions with Maverick in the certificate area you tested for, before your checkride date.
  • Have received an unsatisfactory result on the oral portion of an FAA practical test, and be able to provide the corresponding Notice of Disapproval of Application (FAA Form 8060-5).
  • Submit your refund request within thirty (30) days of your checkride to support@pilotcomputer.com with the supporting documentation.

Approved refunds cover the membership fees paid for the preparation period leading up to that checkride and are returned to your original payment method. The guarantee applies to the oral portion only, is limited to one refund per person, and does not apply where the unsatisfactory result is unrelated to oral exam preparation. This guarantee is our refund commitment for failing the oral — it is not a promise or prediction that you will pass (see Section 9). Nothing in this section limits any non-waivable refund rights you may have under applicable law.

6. Acceptable Use

You agree not to:

  • Share, sell, or transfer your account or login credentials, or let anyone else use your membership.
  • Scrape, crawl, harvest, or otherwise extract content or data from the Service by automated means, or access it through any interface we did not provide.
  • Copy, reproduce, resell, or redistribute the Service, its questions, scoring, or feedback, whether to build a competing product or otherwise.
  • Reverse engineer, decompile, or attempt to derive the source code or underlying models of the Service, except where this restriction is prohibited by law.
  • Interfere with, disrupt, overload, or probe the Service or its infrastructure, or attempt to bypass any rate limits, authentication, or security controls.
  • Upload unlawful, infringing, or malicious content, or use the Service for any unlawful purpose.

We may investigate suspected violations and take appropriate action, including limiting, suspending, or terminating access.

7. User Content

“User Content” means the responses, audio recordings, text, and other materials you submit when you practice with the Service. As between you and us, you retain ownership of your User Content.

You grant Pilot Computer a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and analyze your User Content for the purpose of operating, providing, securing, and improving the Service — including evaluating your responses, generating scoring and feedback, and developing and improving our models and features. Where we use your content to improve the Service, we use de-identified or aggregated data wherever reasonably possible. This license ends when you delete the relevant content or close your account, except for content retained in backups for a limited period, already shared with others, or that we must keep to comply with law.

You are responsible for your User Content and represent that you have the rights necessary to submit it and to grant the license above. Our handling of personal information is described in our Privacy Policy.

8. Intellectual Property

The Service, including its software, AI personas (such as Maverick), question banks, scoring logic, feedback, text, graphics, design, and the Pilot Computer name and logo, is owned by Pilot Computer or its licensors and is protected by intellectual property and other laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own non-commercial checkride preparation. No other rights are granted. References to the FAA, the Airman Certification Standards, and related materials are used for identification and educational purposes only; those materials are the property of their respective owners, and their use does not imply any affiliation or endorsement (see Section 9).

9. Educational Disclaimer

Pilot Computer is a study aid, not flight training. The Service is an educational tool designed to help you practice and build confidence for the oral exam. It is not a substitute for FAA-required training, instruction, or endorsements from a certificated flight instructor (CFI) or other authorized instructor, and it does not replace official FAA guidance, regulations, or materials.

Pilot Computer is not affiliated with, authorized by, sponsored by, or endorsed by the Federal Aviation Administration (FAA) or any government agency. “Maverick” is a fictional AI persona and is not a real Designated Pilot Examiner, instructor, or FAA representative.

We do not certify your readiness for a checkride and do not guarantee that you will pass any FAA test, beyond the specific refund terms described in Section 5. Your performance on an actual checkride depends on many factors outside our control, including your training, study, and the judgment of your examiner. Always rely on your CFI and authoritative FAA sources for decisions about your training and certification.

10. Disclaimers of Warranties

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Pilot Computer disclaims all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that AI-generated content (including questions, scoring, and feedback) will be accurate, current, or complete, or that the Service will meet your requirements or improve any test result. Any reliance you place on the Service is at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, Pilot Computer and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or opportunities, arising out of or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

Our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case, our liability is limited to the smallest extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Pilot Computer and its officers, employees, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms or of any law or third-party right.

13. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if we are required to do so by law, or to protect the Service or other users.

On termination, your license to use the Service ends and we may delete your account and User Content, subject to limited retention for backups and legal compliance. Sections that by their nature should survive termination — including User Content licenses already granted, Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law — will survive.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and take reasonable steps to notify you, such as by email or an in-product notice. Changes take effect when posted unless we say otherwise. Your continued use of the Service after the changes take effect means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You and Pilot Computer agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute that is not otherwise resolved, except that either party may seek injunctive relief in any court of competent jurisdiction. Nothing in this section deprives you of the protection of mandatory consumer-protection laws in your place of residence.
